The Information We Collect

This section discusses the types of information we collect from and about you as you use the Services.

 

Information You Provide to Us

 

When you use our Services, you may choose to provide certain information directly to us. For example, we collect information directly from you when you register for the Services; interact with us through online forms, social media pages, or customer service; subscribe to emails or newsletters; participate in surveys, research, sweepstakes, contests, or events; or otherwise interact with us through the Services. Information we Automatically Collect as you Use the Services

 

There is certain information that we collect automatically from your use of the Services and from your device(s) used to access the Services, using the types of technologies discussed in the “Online Analytics and Advertising” section below. This information includes your IP address, page view statistics, browsing history, usage and click data (e.g., the features you interact with and actions you take, session duration, dates and time of access, diagnostic data) and information about your device (e.g., device identifiers, operating system, and browser type/version).  Based on information such as your IP address, may also determine the general location from which your device accesses the Services.

 

Information obtained from other sources

 

We (or third parties acting on our behalf) may collect additional information about you from public databases, partners, social media platforms, data providers, and other third-parties to supplement the information we collect directly from you.

 

Combined Information

 

For the purposes discussed in this Policy, we may combine the information that we collect through the Services with information that we receive as discussed in this section, and use such combined information in accordance with this Policy.

 

De-identified Information

 

We may de-identify information we collect so the information cannot reasonably identify you or your device, or we may collect information that is already in de-identified form. Our use and disclosure of such de-identified information is not subject to any restrictions under this Policy, and we may use and disclose it to others for any purpose.

 

How We Use Your Information

 

We use your information for the following purposes:

  • To provide the Services and respond to your requests, including to provide customer service
  • To facilitate transactions on the Services
  • If you opt in to participate in a perks/loyalty program (e.g., Preggie Perks), to facilitate your participation in such program and administer rewards per program rules
  • To analyze and improve the Services, and to personalize the Services to your interests
  • To communicate with you with transactional information related to the Services or about updates to our legal terms
  • For research and development
  • In accordance with applicable legal requirements, for advertising and marketing purposes, including to provide you with special offers and promotions both with respect to our products and services and the products and services of third parties that we believe will be of interest to you
  • For our business operations, including maintaining your account, security, fraud prevention, legal compliance, and detecting security incidents and protecting against malicious, deceptive, fraudulent, or illegal activity

The laws in some jurisdictions (including the EU, UK, and Switzerland) require companies to explain the legal grounds they rely on to process your information. Our legal bases for processing your information as described in this Policy are as follows:

  • Contractual Necessity.  Where use of your information is necessary to perform our obligations under a contract or commitment to you. For example, to:

  • Legitimate Interests.  Where use of your information furthers our legitimate interests or the legitimate interests of others. For example, to:

Online Analytics and Advertising

 

Our Services use various technologies provided by us or others such as cookies, beacons, tags and scripts (collectively referred to herein as “cookies”). These technologies are used in analyzing trends, administering the Services, tracking users’ activities on the Services and in gathering demographic information about our user base as a whole. We may receive reports based on the use of these technologies by these companies on an individual as well as aggregated basis.

Online Analytics

 

We may use third-party web analytics services (such as those of Google Analytics) on our Services to collect and analyze usage information through cookies and similar tools; engage in auditing, research, or reporting; assist with fraud prevention; and provide certain features to you. If you receive email from us, we may use certain analytics tools, such as tracking pixels, to capture data such as when you open our message or click on any links or banners our email contains. This data allows us to gauge the effectiveness of our communications and marketing campaigns.

 

Online Advertising

 

The Services may allow third-party advertising technologies (e.g., ad networks and ad servers) to place cookies or other tracking technologies on your computer, mobile phone, or other device to collect information about you to assist in the delivery of relevant advertising as you browse the Internet. These ads may be based on your current activity or your activity over time and across other websites and online services and may be tailored to your interests.

How We Disclose Your Information

 

We may disclose your information to third parties in the following ways:

  • Affiliates. We may disclose information to our affiliates under common ownership and/or control for the purposes outlined in this Policy.
  • Service Providers. We may disclose information to our third-party service providers, vendors, or others who provide services for Marquee’s business operations and on our behalf. This may include providers of services such as infrastructure, hosting, data analysis, order fulfillment, IT services, customer service, professional services or audit services, among others.
  • Advertising and related analytics providers. As explained above, we may allow third-party advertising technologies (e.g., ad networks and ad servers) and related analytics providers to use cookies and similar technologies on the Services to deliver relevant, tailored content and advertising to you.
  • Partners and marketers. We may disclose information to partners for joint marketing and promotional purposes and to other marketers so they can market their products and services to you.
  • Legal and Safety Disclosures. We may disclose Information as necessary or appropriate under applicable laws (including laws outside your country of residence) to: comply with legal process or requirements, including applicable notification obligations; respond in good faith as necessary to requests from public and government authorities (including public and government authorities outside your country of residence); enforce our terms and conditions; and protect our operations or those of any of our affiliates and our rights, privacy, safety, or property, and/or that of our affiliates, you or others.
  • Business Transactions. We may disclose Information in the event of a proposed or actual reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of Marquee’s business, assets or stock (including in connection with any bankruptcy or similar proceedings).

Information for Users of Motherhood.com

 Motherhood.com is designed to help expectant mothers find clothes and other products to help them on their journey to motherhood. When you create an account with us on Motherhood.com, we will ask and store information related to your due dates to help us personalize our marketing and other services to provide you with the best products and advice tailored to your pregnancy. 

We disclose your personal pregnancy information to service providers who help us provide our services to you, including marketing new products and information from us to you based on where you are in your journey to motherhood.  

If you opt into our Preggie Perks program, we also disclose your contact information, due dates, and other pregnancy related information (trimester and number of children) to partners who can provide you and your growing family with additional offers and services. If you sign up for Preggie Perks, we may collect and provide the following information to our partners:

  •     Contact information
  •     Due Date
  •     Mailing Address
  •     Date of recent purchase
  •     Email address
  •     Phone number

Your Rights and Choices

 

Your Rights

 

We provide you with the ability to exercise certain rights regarding our collection, use, and disclosure of your information. Your legal rights to exercise such controls and choices vary based on the laws of your jurisdiction. Depending on the laws in your jurisdiction (which includes the EU, UK, California, Colorado, Connecticut, and Oregon), you may have the ability to request:

  • Access to, or a copy of, your information in a structured, commonly used and machine-readable format
  • Correction or amendment of your information
  • Deletion of your information
  • Transfer of your information to a third party, where technologically feasible
  • Restriction or objection to certain uses of your information
  • Withdrawal of your consent where our processing operations were based on your consent

We may ask you to provide us with information necessary to reasonably verify your identity before responding to your request. We will consider all requests and provide our response within the time period required by applicable law. Please note, however, that certain information may be exempt from such requests. To exercise your rights, please contact us using the contact information provided below.  Depending on your jurisdiction, you may have the ability to appeal our decision.  In such circumstances, we will inform you of your appeal rights and how to exercise it in our response to your request.

 

We will not discriminate against you for exercising your rights. This means that we will not penalize you for exercising your rights by taking actions such as denying you services; increasing the price/rate of services; decreasing service quality; or suggesting that we may penalize you as described above for exercising your rights.

 

You also have the right to lodge a complaint with the supervisory authority or regulator in your jurisdiction of residence.

Your Marketing Choices

 

In accordance with applicable law, we may send you promotional offers, updates, and other marketing communications.  You can opt out of email marketing using the unsubscribe link in those communications. You may also contact us at the contact information provided below and request that we no longer use your information for marketing purposes. We will process such requests in accordance with applicable law. Please note that even if you opt out of receiving marketing communications from us, you may still receive transactional communications about the Services or legal notifications.

 

You may elect to receive marketing SMS/text messages from us or third parties acting on our behalf for marketing and/or non-marketing purposes. These messages may use information automatically collected based on your actions while on our Services and may prompt messaging such as cart abandon messages. You may opt out of receiving text messages at any time by texting “STOP” to our text messages. Sale/Targeted Advertising Opt Out Rights

 

Under the laws in certain US states (e.g., California, Connecticut, Colorado, Oregon, Texas, and Virginia), you have the right to opt out of our processing or sharing of your information for online targeted advertising purposes. Note that certain state laws also allow you to opt out of the “sale” of your information to third parties in exchange for valuable consideration. We may use analytics and online advertising tools that result in the disclosure of your information to our third-party partners and that are subject to these opt out rights. Please note that we will also honor browser-based opt out signals (such as the global privacy control) in accordance with our legal obligations.

 

How We Secure Your Information

 

It is your responsibility to ensure that the information you provide to us can be legally collected in the country of origin, transmitted to us and maintained or used by us. We employ a variety of technical, organizational, and physical measures to protect the information submitted to us, both during transmission and once we receive it. No method of transmission over the internet, or method of electronic storage, is 100% secure, however. Therefore, we cannot guarantee its absolute security. If you have any questions about the security of the Services, or reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of any account you might have with us has been compromised), please notify us immediately in accordance with the “Contact Marquee” section below.

 

Data Retention

 

We will retain your information for the period necessary to fulfill the purposes outlined in this Policy, unless a longer retention period is required or not prohibited by applicable law.  When determining the appropriate retention period for the information we process and store, we take into account various criteria, such as the type of Services requested by or provided to you, the nature and length of our relationship with you, the impact on the Services we provide to you, and legally required retention periods.

 

Notification of Policy Changes

 

We may change this Policy from time to time. If we make changes, we will post an updated Policy on the Services, and it will become effective as of the date of posting (“Effective Date”). We will also comply with applicable legal requirements regarding Policy updates and any notice or consent requirements. We encourage you to periodically review this page for the latest information on our privacy practices. Your use of the Services following these changes means that you accept the revised Policy.

 

Children’s Privacy

 

Our Services are not directed to children, and we do not knowingly collect identifiable information from children under the age of 18. If you learn that a child has provided us with identifiable information in violation of this Privacy Policy, please contact us as indicated at the end of this Privacy Policy.  We will then take steps to delete such information in accordance with and if required by applicable law.

 

Third Party Links and Features

 

Our Services may contain features or links to websites and Services provided by third parties.  Any information you provide on third-party websites or Services is provided directly to the operators of such websites or Services and is subject to those operators’ policies governing privacy and security, even if accessed via our Services. We are not responsible for the privacy and security practices of third parties to which links or access are provided through our Services. We encourage you to learn about third parties’ privacy and security policies before using their services or providing them with your information.

 

Additional Information for International Users

 

Marquee is located in the United States, and maintains processing operations in various global jurisdictions.  We may therefore transfer your information to countries other than the country where you are located, including to the US or any other country in which we or our service providers maintain facilities. If you are located in the EU, UK, or other regions with laws governing data collection and use that differ from US law, please note that we may transfer your information to a jurisdiction that does not have the same data protection laws as your jurisdiction. We may also transfer your information to countries for which adequacy decisions have been issued, use approved contractual protections for the transfer of information, or rely on third parties’ Data Privacy Framework certifications, where applicable.

 

Additional Information for California Residents

 

If you are a California resident, the California Consumer Privacy Act (“CCPA”) requires us to provide you with the following additional information about:

  • the purpose for which we use each category of “personal information” (as defined in the CCPA) we collect; and
  • the categories of third parties to which we (a) disclose such personal information for a business purpose, (b) “share” personal information for “cross-context behavioral advertising,” and/or (c) “sell” such personal information.

Under the CCPA, “sharing” is defined as the targeting of advertising to a consumer based on that consumer’s personal information obtained from the consumer’s activity across distinct online services, and “selling” is defined as the disclosure of personal information to third parties in exchange for monetary or other valuable consideration. We “share” information with our advertising partners to provide more relevant and tailored advertising to you regarding our Services. Moreover, our use of third-party analytics services and online advertising services may result in the sharing of online identifiers (e.g., cookie data, IP addresses, device identifiers, and usage information) in a way that may be considered a “sale” under the CCPA.

Financial incentives. Please see the “Notice of Financial Incentives and Bona Fide Loyalty Programs” section immediately below.

Right to Limit. The CCPA allows you to limit the use or disclosure of your “sensitive personal information” (as defined in the CCPA) if your sensitive personal information is used for certain purposes. If you are a Motherhood.com user and do not want us or our partners using sensitive information about your expected due date or pregnancy status to provide you with these offers, please contact us via e-mail here.

Notice Concerning Do Not Track.  Do Not Track (“DNT”) is a privacy preference that users can set in certain web browsers. We are committed to providing you with meaningful choices about the information collected on our website for third-party purposes, which is why we describe a variety of opt-out mechanisms above. However, we do not currently recognize or respond to browser-initiated DNT signals. Please note that DNT is different from the browser-based privacy signal (the global privacy control) referred to above, which we do honor.

Notice of Financial Incentives and Bona Fide Loyalty Programs (for California and Colorado Residents)

As an incentive for providing us with your personal information, you may receive a financial benefit in the form of discounts, special offers, free gifts or other benefits to customers who sign up to receive our marketing communications, join a bona fide customer rewards/loyalty program (e.g., Preggie Perks), complete a survey, or enter a contest, sweepstakes or other similar promotional campaigns (collectively, the “Programs”). When you participate in a Program, we collect personal identifiers such as full name and contact information including email address as well as personal and demographic information you choose to provide (and for Preggie Perks, the additional information discussed above in the “Information for Users of Motherhood.com” section above). To offer you these Programs, we may disclose this information to service providers and third parties, such as advertising networks, marketing partners, and data analytics providers.

You can opt into a Program by following the sign-up instructions, and you have the ability to opt-out at any time by contacting us here. In some cases, we may provide additional terms and conditions associated with a particular Program, which we will provide to you when you sign up. In offering the Programs, we consider the value of the free or discounted products or service or other benefits we offer as well as our expenses in offering the Program and ensure that the benefits we offer to consumers are reasonably related to the value of collecting consumers’ personal information to us, such as by being able to reach them with marketing communications or better understand their preferences. Please note that if you request deletion of part or all your personal Information, that could affect your ability to qualify for a Program.
